Terms & Conditions

  1. These Terms and Conditions shall apply to the supply of products/provision of services for all contracts between The Video Advert Company, hereinafter referred to as the Supplier, and customer hereinafter referred to as the Client.
  2. A binding contract will only come into existence on receipt of the Client’s confirmation to proceed via email and payment of a deposit. The services of a presenter or voiceover artist can only be secured once the deposit has been paid. Please note that from time to time we offer a discounted rate on multiple videos. This rate can only be secured when the same voice-over artist is used for all videos commisioned by the client on the back of the offer.
  3. Fees applicable are those as detailed in the invoice and represent goods/services provided in respect of this project,. For location shoots this includes billing for travel time, whether at the client’s premises or elsewhere. Fees (and expenses where applicable) will be paid by the client in pounds sterling (GBP).
  4. Provisional studio dates can be booked - prior to payment. If however they are not required, they need to be cancelled via e-mail within 5 working days or a 25% cancellation fee becomes payable. If a shoot is cancelled due to delays caused by the Client, the deposit becomes non-refundable. Reasons for delays can include emergent issues/information, or hold ups in the script approval process.
  5. The Supplier will not be held responsible if a shoot is cancelled, or delayed, due to circumstances beyond their control, such as severe weather or transportation strikes.
  6. 50% of the project cost will be payable in advance at the start of the project, with the balance due upon completion. The video files will only be released when the balance payment has been received.
  7. On completion of the work, a preview version will be placed online for the client to view. The client has up to two feedback passes to make any changes to the visuals such as motion graphics and text. The re-recording of the presenter or voice artist is not covered within feedback passes and if the client requires this, an additinal fee will be charged. This is why script sign-off is so important. Please note that it is the responsibility of the client to provide guidance on unusual pronunciations of names or technical details contained in the approved script. Please note that should the client ask for new work to be implemented (that which falls outside of scope of the original project) this will be charged seperately and will become due immediately. Once the 2nd pass of feedback is implemented, it is deemed that the project is complete and the balance falls due. An invoice will be sent to the client for immediate payment.
  8. If no feedback is received within 15 days of the online preview being uploaded, it is deemed that the project is complete and an invoice will be sent to the client for the balance payment.
  9. The project may be terminated by either party, giving to the other two weeks’ notice in writing. The Supplier will, upon termination of the project, invoice the Client for all work completed and all expenses incurred up to the end of the notice period.
  10. The time taken to complete the work and the measure of its success depends, in part, upon factors outside the control of the Supplier. Any changes to the elapsed timescales proposed for this project will be advised to the Client at the earliest possible time.
  11. Any forecast or estimates made by the Supplier for the project and the results attainable are given in good faith, having regard to the information made available by the Client, and represents the Supplier’s interpretation of the Client’s instructions. Any such estimates and any confirmation, or variance from them, in subsequent reports and correspondence shall not be taken in any respect as an undertaking, warranty or contractual condition.
  12. From time to time, samples of our work may be uploaded to the TVAC YouTube channel. Unless otherwise stated at the start of the project, consent to use the video for promotional purposes is assumed. If the content of a video is deemed to be confidential or not suitable for the public domain, then the client must request in writing, that any video outputs be protected.
  13. Any additional work that is not part of the invoice, that is being asked of the Supplier, is deemed not part of the contract and will be subject to separate negotiation and fee. Acceptance of the additonal fee needs to be confirmed in writing by the Client.
  14. All source files (i.e. native footage etc, AE and PP project files) are the property of The Video Advert Company and will not be released. Upon payment of the final balance, the client has full rights and permissions to use the final edited video for all reasonable promotional and advertising work - including upload to websites and social media platforms.
